RiseArmament.com is operated by RISE Armament. These Terms of Use (this “Agreement”) state the terms and conditions under which you may access or browse the RISE Armament Website (the “Website”) and govern your use of the Website. By using the Website, you agree to be bound by this Agreement, whether you are simply accessing or browsing the Website or you are purchasing products offered for sale on the Website (“Products”) as a registered customer. If you wish to access or browse this site, shop for or purchase Products, please read these Terms of Use carefully. If you object to anything in this Agreement or the RISE Armament Privacy Policy, you should leave the Website.

Electronic Agreement/Modification. This Agreement is an electronic contract that sets out the legally binding terms of your use of the Website and your purchase of Products. By accessing the Website or becoming a registered customer, you consent to have this Agreement provided to you in electronic form. This Agreement includes RISE Armament’s Privacy Policy and any notices regarding the Website. By accessing the Website or clicking the Accept Button and becoming a registered user, you accept this Agreement and agree to the terms, conditions and notices contained or referenced herein.

B. Modification. This Agreement may be modified by RISE Armament at its sole discretion from time to time, such modifications to be effective upon posting by RISE Armament on the Website and your use of the Website after such posting will constitute acceptance by you of such changes. Please consult this Agreement regularly. This Agreement was last updated on December 1, 2014.

C. Access and Retention. A link to this Agreement will be found on the RISE Armament website. In order to access and retain this electronic Agreement, you must have access to the World Wide Web, either directly or through devices that access web-based content, and pay any service fees associated with such access. In addition, you must use all software and equipment necessary to make such connection to the World Wide Web, including a computer and modem or other access device. Please print a copy of this document for your records. To retain an electronic copy of this Agreement, you may save it into any word processing program.

ACCEPTANCE OF TERMS OF USE AGREEMENT

PRIVACY POLICY
Please refer to our Privacy Policy, which is incorporated into this Agreement by this reference.

ELIGIBILITY
You must be at least eighteen (18) years of age to purchase Products, register with or otherwise use the Website. By using the Website, you represent and warrant that: (a) you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement; (b) all registration and listing information you submit is truthful and accurate; (c) you will maintain the accuracy of such information; (d) you are 18 years of age or older; and (e) your use of the Website does not violate any applicable law or regulation.

WEBSITE CONTENTS
Occasionally there may be information on the Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing and/or availability. RISE Armament reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). RISE Armament apologizes for any inconvenience this may cause you.

COUPON/PROMO CODES
Coupons and promo codes are valid for a limited time only. RISE reserves the right to modify or cancel coupons at any time. If you do not purchase the qualifying items added to your Cart when the coupon is in effect, the discount will not apply. Coupon stacking is not allowed, only 1 coupon per order will be allowed. On occasion, RISE will enable the use of multiple coupons for certain promos.

ELECTRONIC COMMUNICATIONS
When you visit the Website or send e-mails to RISE Armament, you are communicating electronically. You consent to receive communications from RISE Armament electronically. RISE Armament will communicate with you by e-mail or by posting notices on the Website. You agree that all agreements, notices, disclosures and other communications provided to you electronically satisfy any legal requirement that such communications be in writing. You also agree that by signing up for RISE Armament e-mails you consent to receiving products, promotions and other advertisements from RISE Armament or its partners.

PRODUCT INSPECTION
Before a firearm or part leaves the factory, it is tested, carefully inspected, and packaged. RISE Armament cannot control product handling after the product leaves the factory. Therefore, please examine the product carefully upon receipt to ensure it is unloaded and undamaged.

PRODUCT RETURNS
If you are not completely satisfied with your Website purchase, you may return the unused products with your receipt within 30 days from the date of purchase to:

All returned merchandise must be accompanied by a completed Return/Exchange Form. Customer will be responsible for all freight and shipping charges on items returned that are not the result of Seller’s error. RISE Armament is not responsible for lost shipments on items being returned. RISE Armament will cover the freight costs for shipping exchanged items to the Customer. Returns will not be accepted on merchandise that has been altered, laundered, or modified in any way. Customers must inspect all packages upon receipt. All damaged or incorrect items will need to be sent back to RISE Armament upon receipt for a credit, and must be postmarked within 30 days of the purchase. RISE Armament will send a prepaid shipping label to Customer for the damaged or incorrect item to be sent back to RISE Armament.

This Website may contain advertisements for or information about third-party providers of information, services, products, or links to their websites. The owners and affiliates of such providers are referred to in this Agreement as “Third-Party Vendors”. Such advertisements, information and links do not and shall not be construed as approval or endorsement of such vendors or their websites. If you decide to deal with such vendors or visit such sites, your use of such sites is subject to any applicable rules and policies of such Third-Party Vendors including any applicable terms of use agreements or privacy policies of such Third-Party Vendors. Third-Party Vendors have no authority to act on our behalf or to bind us, and we are not responsible for the actions of Third-Party Vendors. You shall be responsible for taking such steps, as you deem appropriate to evaluate Third-Party Vendors and their services and products and otherwise protect your legitimate interests. RISE Armament is not and shall not be construed to be a party to any transactions that may be entered into between you and Third-Party Vendors.

USER GENERATED CONTENT
RISE Armament assumes no obligation to monitor the contents of user generated sections of the Website but reserves the right to refuse to accept and to remove any posting at any time. You agree not to post any information or materials that violate intellectual property laws, that are obscene, pornographic, defamatory, violent, harassing in nature, or that otherwise violate applicable laws or community standards, that solicit or promote any illegal activity, or that do not pertain to the applicable subject matter. You agree that by providing you with the ability to view and distribute user generated content, RISE Armament is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any content or activity on the Website. RISE Armament reserves the right to block or remove communications or materials that it determines, in its sole discretion, to be (a) abusive, defamatory, or obscene; (b) fraudulent, deceptive or misleading; (c) in violation of a copyright, trademark or other intellectual property right of another; (d) violates any law or regulation; or (e) offensive or otherwise unacceptable to RISE Armament. You acknowledge that any information and materials posted on this Website are subject to use by RISE Armament in connection with operating this Website and promoting our business and as otherwise contemplated by this Agreement without further notification to or permission by you. All electronic mail or communications provided to us may be used by us for any purpose without compensation to the contributor, subject to our then existing privacy policy.

FIREARM SHIPMENTS

WE SHIP ONLY TO VALID FFL DEALERS.

The customer is responsible for knowing his/her state laws regarding firearm transfers.

Contact your local FFL dealer with any questions regarding the sale or transfer of firearms.

Contact your local FFL before ordering a firearm to verify their transfer fee and to ensure they will receive your transfer.

The customer assumes all responsibility and cost for returned firearms due to FFL refusal or failure to receive.

If you order a handgun, stockless shotgun, or stripped lower receiver, YOU MUST be:

A legal resident of the state in which you are ordering.
2. 21 years of age or older to complete the transfer through your FFL.
Exceptions – Military personnel stationed in a state other than their legal residence may purchase firearms across state lines.

Contact your local FFL receiving the transfer as you may have to provide proof of deployment, residence, etc.
RISE Armament reserves the right to cancel and stop shipment on any order where RISE receives information indicating the recipient might engage in any criminal or unlawful use.

Please follow all directions prompted to you at checkout. This will ensure speedier delivery. The customer may be asked to provide the FFL information that they wish to use. If a customer wishes to change the FFL they want to use after the order has shipped, there will be an additional charge for the cost of shipping. If a FFL is not available at the time of delivery, the product will not be shipped until a valid FFL is verified. Additional shipping charges will apply to orders that need to be reshipped.


RISE Armament will not ship any AR-specific parts to Connecticut.

All such orders will be cancelled and the customer will be charged a 5% fee.

Stripped lower receivers will NOT be shipped to the following states:

– Connecticut
– Maryland
– Massachusetts

Complete lower receivers will NOT be shipped to the following states:

– Connecticut
– Maryland
– Massachusetts
– New Jersey
– New York

Non-Compliant models will NOT be shipped to the following states:

– California (RISE Armament will not install a “bullet button” on ANY firearm from another manufacturer)
– Connecticut
– Maryland
– Massachusetts
– New Jersey
– New York

Exceptions: LEOs must provide both their credentials and a letterhead signed by their department’s superior officer stating that the firearm will be used in the execution of the LEO’s duties. RISE Armament only recognizes City Police Officers, County Sheriff Deputies and State Police (including Highway Patrol) as LEOs. Not all the states listed may have LEO exemptions. Please contact us BEFORE placing your order. RISE Armament does NOT ship directly to LEOs; the order must go to a valid FFL. RISE Armament does NOT make exceptions for this policy.


MAGAZINE ORDERING RESTRICTIONS

RISE Armament

  • ABIDES by all state regulations regarding the sale of high capacity magazines.
  • DOES NOT ship high capacity magazines (those greater than 10 rounds) with firearms to the states listed below.
  • WILL NOT replace high capacity magazines with state compliant magazines.
  • DOES NOT offer refunds in place of the magazines.

It is the customer’s responsibility to understand and comply with state laws regarding magazine capacities.

Customers ordering magazines that are illegal to own in their state will have their orders cancelled and will be charged a 5% restocking fee.

States with applied magazine restrictions:

  • California – no magazines greater than 10 rounds
  • Colorado – no magazines greater than 15 rounds
  • Connecticut – 10 rounds and less with a valid permit
  • Hawaii – no magazines greater than 10 rounds
  • Illinois – North Chicago – no rifle magazines greater than 16 rounds
    Aurora, Skokie, Chicago, Evanston – no rifle magazines greater than 15 rounds
    Highland Park, Cook County, Dolton, Homewood – no rifle magazines greater than 10 rounds
  • Maryland – no magazines greater than 10 rounds
  • New Jersey – no magazines greater than 15 rounds
  • New York – no magazines greater than 10 rounds
  • Massachusetts – no magazines greater than 10 rounds
  • Ohio – no magazines greater than 30 rounds

Exceptions:
LEOs must provide both their credentials and a letterhead signed by their department’s superior officer stating that the magazine/weapon will either be used in the execution of the LEO’s duties, or off duty. RISE Armament only recognizes City Police Officers, County Sheriff Deputies and State Police (including Highway Patrol) as LEOs.

RISE Armament will not ship high capacity magazines to a High Capacity Magazine Dealer through a customer order. High Capacity Magazine Dealers in CA may place orders with RISE Armament directly.

ITAR
Many of our products and their components are subject to the International Traffic in Arms Regulations (ITAR). Export is strictly prohibited without prior authorization or a license issued by the U.S. Department of State’s Directorate of Defense Trade Controls. Violations of export laws are subject to severe penalties. Data, including any documents or engineering drawings, prints, etc. that can be viewed, downloaded, or printed from our website may contain technical data that may not be exported outside of the United States or released or disclosed to non-U.S. persons inside the United States without prior written authorization by the relevant U.S. Government agency.

WARRANTY LIMITATION
Except for those warranties expressly provided herein, you hereby acknowledge and agree that RISE Armament (including officers, employees, agents, directors and independent contractors of RISE Armament) has not made any other warranties, express or implied, concerning the Website or the Products. The Website and all Information, Content, Materials, Products (including Software) and services included on or otherwise made available to you through this site are provided by RISE Armament on an “as is” and “as available” basis, unless otherwise specified in writing. RISE Armament disclaims, and you hereby waive, all warranties expressed or implied, including, without limitation, all implied warranties of merchantability and fitness for a particular purpose.

DISCLAIMER OF LIABILITY
In no event shall RISE Armament or any of its officers, directors, shareholders, employees, distributors, affiliates, subsidiaries, agents or representatives be in any way liable to you or any party for any direct, indirect, general, compensatory, incidental, special, punitive, consequential or exemplary damages, or any other damages whatsoever, arising from, or relating to, the use of or inability to use the website or the content, materials and functions thereof, or of any linked website, or any product or service linked to, from or advertised or promoted on the website, or otherwise relating hereto, regardless of whether the same are foreseeable or if RISE Armament was advised of the possibility of such damages.

You acknowledge, by your use of the website, that your use is at your sole risk, that you assume full responsibility for all costs associated with all necessary servicing, repairs or replacement of any equipment, hardware, software or data you use in connection with your use of the Website and that RISE Armament shall not be liable for any damages of any kind related to your use of, or inability to use, the website.

RISE Armament makes not representation or warranty that the Website, Content, Software or any Product offered or purchased through the website is applicable or appropriate for use or access in locations outside the United States.

Notwithstanding anything to the contrary contained herein, RISE Armament’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to RISE Armament for the Products.

ADDITIONAL DISCLAIMERS
The content of this site does not constitute advice and should not be relied upon as such. The assembly or installation of firearm parts and components should only be performed by a qualified gunsmith or certified armorer. RISE Armament is not responsible for any injury or damage resulting from the improper installation or use of our products.

Always have a competent gunsmith assemble your barrel kit, barrel, or rifle kit and headspace your barrel before first use. Using a rifle assembled incorrectly or assembled using incorrect or modified parts can result in a damaged rifle, property damage, personal injury, or death.

It is the customer’s responsibility to ensure the customer abides by all applicable National Firearms Act (NFA) rules and regulations, as well as any applicable state and/or national laws and requirements.

It is the customer’s responsibility and duty understand firearm safety and to properly secure and handle firearms. Firearm safety information may be found on such sites as www.projectchildsafe.org.

INDEMNIFICATION
You agree to indemnify and hold RISE Armament, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, damages, claim, actions, or demand, including reasonable attorney’s fees, made by any third party due to or arising out of your use of the Products in violation of this Agreement and/or arising from ANY USE OF THIS WEBSITE.

FORCE MAJEURE
RISE Armament shall not be liable for failing to perform its obligations hereunder because of circumstances reasonably beyond the control of RISE Armament. Such circumstances shall include (without limitation) any acts or omissions of any government or governmental authority, natural disaster, act of a public enemy, acts of terrorism, riot, sabotage, labor disputes, power failure, delays in transportation or deliveries of supplies or materials, acts of God, computer failure, hardware failure, telecommunications failure, software failure, failure of users to cooperate with the reasonable requests of RISE Armament, breach of this Agreement by users, and any other events reasonably beyond the control of RISE Armament.

STATUTE OF LIMITATIONS
All actions arising from the website or purchase or use of a RISE Armament product must be brought within one (1) year or else they are waived.

CONSENT TO JURISDICTION, FORUM SELECTION AND CHOICE OF LAW
By using the Website you expressly agree that if there is any dispute arising out of the Website and/or the Products, or in the event of any judicial action arising directly, indirectly or otherwise in connection with, out of, related to or from this Agreement or any transaction covered hereby or otherwise arising in connection with the relationship between the parties, regardless of whether such action is brought under contract, tort, statute or otherwise, any such dispute shall be governed by the laws of the State of Oklahoma, without regard to its conflict of law provisions, and you expressly agree and consent to the exclusive jurisdiction and venue of the state and federal courts of the State of Oklahoma, in Tulsa County, for the resolution of any such dispute. The aforementioned choice of venue is intended by the parties to be mandatory and not permissive in nature, thereby precluding the possibility of litigation between the parties with respect to or arising out of this Agreement in any jurisdiction other than that specified in this paragraph. You hereby waive any right you may have to assert the doctrine of forum non convenience or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph, and stipulate that the State and Federal courts located in the County of Tulsa, State of Oklahoma shall have in personal jurisdiction and venue over you for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to this Agreement. Any final judgment rendered against a party in any action or proceeding shall be conclusive as to the subject of such final judgment and may be enforced in other jurisdictions in any manner provided by law.

ENTIRE AGREEMENT
This Agreement contains the entire agreement between you and RISE Armament regarding the use of the Website. The Privacy Policy Statement (as modified by RISE Armament from time to time) is incorporated herein by this reference and made a part of this Agreement.

SEVERABILITY
If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

CAPTIONS
The headings and captions of this Agreement are inserted for convenience of reference and do not define, limit or describe the scope or intent of this Agreement or any particular section, paragraph or provision.
